Filing Lien After Partial Payment

I've sent a notice of intent to lien via Levelset and it got the customers attention. They didn't have enough to pay the full balance, so I took a credit card for $2k of the $10915 they owe me. I have 2 questions, if I file a lien on the property can I just do it for the remaining balance? Also I'd like to know how far ahead of my deadline should I file to make sure everything goes in before its too late

I am glad you were at least paid part. I hope they will pay the rest before you must file suit to foreclose on the lien. To your questions, the filed lien statement can only be for the amount due at the time of filing. Be very careful about this and make sure the amount is entirely accurate. You can file the lien statement now and there really is no reason to delay filing, generally. The key mistake the contractors make is the timing as it must include the 10 days of notice. Do not wait until the last minute and be sure to get it in well before any deadline.
