Filing a Lien.

This is Young Choi from JBM Piping & Construction,Inc, the Kings Canyon Connectivity job was completed around the end of February, 2020 and I having a hard time getting paid and i need to know if i can file a lien without sending intent to lien letter first and what to do after the filing a lien. Thank you 213-999-1388

You have 90 days from project completion to file a lien (absent a notice of completion or cessation). So if the project was completed back in February, you are likely too late. But if any work has been done within the last 90 days on the project (by any trade) you can move forward with a lien. Otherwise your remedies likely will be for breach of contract and potentially prompt payment penalties. Hello Young,

Is this is a public work of improvement or a private project? Assuming the former, you will not be asserting a mechanics lien, but likely asserting both a stop payment notice and a claim on the payment bond. More information is needed to make sure we provide the correct guidance.
