Hi , I have a customer that has stopped communications with us , i have an invoice from 10/25/19, the last contact with Platinum Paving was 3/9/20 we didnt file a prelien. Can I still file a lien on this project

Generally, a preliminary notice is required in order to retain the ability to file a valid and enforceable mechanics lien in Nevada. Parties who contract directly with the property owner do not need to send any notice prior to filing a lien on a commercial project, and are only required to send a "Notice of Intent to Lien" at least 15 days prior to filing a lien on a residential project. All other parties (those who did not contract directly with the property owner) are required to send a preliminary notice to the owner and GC within 31 days of first furnishing labor or material to the project; and on residential projects, also provide the notice of intent to lien at least 15 days prior to filing the lien. If the notice requirements have been met or do not apply, the deadline to file a Nevada mechanics lien is usually 90 days from the later of:
  1. the completion of the work or improvement as a whole; or
  2. the last furnishing of labor or materials by the lien claimant.
Note, however, that this deadline can be shortened to 40 days if a Notice of Completion is filed.
