Fighting a mechanic lien by subctonractor when contrctor chose to take $$ and didn't pay sub

CaliforniaBankruptcyMechanics Lien

I'm a customer of Petersen Dean and paid them in full to complete a solar job in Southern California, which included exdtra $$$ for an electricaly panel upgrade completed by a subcontractor. PetersenDean took the exta $$$ but did not oay the subcontractor. The subcontractor is attempting to place a lien on my home (I received 20-day notice) and we (me and subcontractor) have no written agreement and i did pay for their work thrugh PetersenDean, which filed Chapter11 last week. What can I do to protect my property considering I am completely innocaten and have paperwork to show I paid for the work already?

You should have a construction lawyer review the notice you received, ensure that the notice was both timely and properly served on all necessary parties, and determine if there are any other defenses available to you. This will help to determine whether you indeed have "double payment liability" even though you paid Petersen Dean already). You may also want to take steps to assert a claim on Petersen Dean's license bond (although I imagine there will be many claimants) and take some action in the bankruptcy action (including filing a claim) which I understand is now pending in the United States Bankruptcy Court in Nevada. ---CN
