We are a Roofing Contractor, we filed a mechanic's lien last year in September. The homeowner received the notice but still didn't paid. How can we enforce the lien? and what happens if he doesn't have the money to pay?
You now have 6 months in which to sue to enforce the lien in Circuit Court where the property is located. The end result of this process is determination of the priority of your lien and then possible forclosure on the property. If the Homeowner is out of money, the likely result would be to sell the property. Of course all of this is contingent on the proper recording of the lien, how much is at issue (Circuit Court is expensive) and your desire to go through the litigation process.
