Does the original claimant need to be the one to mail in a mechanics lien release?

CaliforniaLien Releases

We recently received final payment on a project and are issuing a lien release. The owner is demanding that the notarized lien release be sent to their office so that they can mail it themselves to the recorder. Is this acceptable? Or are we - the original claimant - the ones who must send the release via certified mail?

Congratulations on getting paid! The way lien releases typically work, is that the claimant, once paid, will file a lien release and send a copy of the recorded release to the property owner. However, there is no specific requirement that the claimant themselves actually file the document. As long as it's signed and notarized by the party who filed the claim then there should be no issue.
