Does the current 60-day timeframe or the new 90-day timeframe still start from the last day you were on the property?

This pertains to the new lien law changes for Georgia that take effect January 1, 2021.

No. As it relates to lien waivers, it starts from the date of the lien waiver. So in theory, you’re doing a lien waiver every month with each pay app. And you’re having to constantly monitor the date of the lien waiver and when the payment arrives and whether or not you need to file an affidavit of non-payment.

Mr. Cobb, I hope you’re well. I was a Superintendent on a project and employed by the prime general contractor. I was fired and subsequently not paid outstanding wages. Do I have lien rights in the state of GA and if so what type of lien would I file? Thank you.
