Does it make sense to send a prelim in this case or do I just have to sue him?

I have been working time and material on a verbal contract for several project addresses for the same client for several months. He has always paid me within a week or so on the same terms. Note that the first project I did for him I do have a signed T&M contract with a prelim on the back of the contract. He has now gone dark and he is outstanding on the following: $2,768.46, sent 6/17 $3,600.00, sent 7/15 $2,758.74, sent 7/16 Does it make sense to send a prelim in this case or do I just have to sue him?

If your a subcontractor for a general contractor then you can do the preliminary notice on the dates in July. It's too late for the June invoice, so you can only receive those funds via negotiation, mediation, surety bond, or Small Claims. There are limits on Small Claims filings, so it's usually best to try and work it out before filing unless Statute of Limitations is close.
