Does a joint check agreement need to reference the state laws

Our standard joint check agreement has the phrase "This Agreement shall be interpreted in accordance with the laws of the State of Massachusetts." Is this necessary?

Not particularly. A joint check agreement is widely accepted and brief, and there is probably little chance that designation of Massachusetts law will change the way any provisions are interpreted. Massachusetts law will in all likelihood govern the transaction assuming the parties are in Massachusetts, anyway.
