Florida Notice of Commencement requirements

The Florida Notice of Commencement (NOC) requirements are found under Fla. Stat. §713.13. This provision states that an owner, before actually commencing to improve any real property shall... record a notice of commencement. There is an exception to this rule, are projects where the total project costs are less than $2,500. For all other projects, an NOC is required.

Failure to file a Notice of Commencement

One of the main reasons to file a Notice of Commencement is that getting inspections you will not be able to acquire the required inspections without one. As it's required to be filed before inspections will be conducted and approved. Another issue is concerning the mechanics lien liability to anyone working on the improvement. All of this is spelled out right on the Notice of Commencement form itself: WARNING TO OWNER: YOUR FAILURE TO RECORD A NOTICE OF COMMENCEMENT MAY RESULT IN YOUR PAYING TWICE FOR IMPROVEMENTS TO YOUR PROPERTY. A NOTICE OF COMMENCEMENT MUST BE RECORDED AND POSTED ON THE JOB SITE BEFORE THE FIRST INSPECTION.
