Does a contractor have to provide a homeowner with documentation of work performed in California?

CaliforniaConstruction ContractDefects

Our home warranty company sent a contractor out to fix our pool heater, twice. The contractor failed to leave any documentation or work order memorializing what work was or was not done on the heater. The home warranty company refuses to provide us documentation. We have no idea was work was or wasn't performed.

When a contractor is hired directly by a homeowner, then there are significant home improvement contract requirements. However, when a contractor is sent out via a home warranty company, I'm not sure that there will be the same level of documentation given for the work. Looking to the terms of the warranty agreement might provide some clarity. That contract might dictate what documentation will be required when repairs must be made. If problems continue, and if the warranty company refuses to cooperate, then involving a local California construction attorney could help to move things along. They'll be able to review your agreement and advise on the rights and responsibilities under the contract. And, they can also help to make demands, negotiate, or bring claims, if that becomes necessary.
