Most Illinois construction businesses won't need a written contract in order to file a valid and enforceable mechanics lien - and a verbal contract may be sufficient. As set out in the following article, Indiana will require that a written contract be in place in order to file a lien for certain public projects - but for privately-owned projects, there doesn't appear to be any written contract requirement: Can You File a Lien Without a Written Contract? For more information on Indana mechanics liens, below are some great resources. Additionally, keep in mind that a Notice of Intent to Lien could lead to payment without the need for a mechanics lien filing. - Indiana Mechanics Lien Guide and FAQs - How to File a Mechanics Lien in Indiana
