Do I have to do a NTO if the customer and owner have different names but same address?

FloridaPreliminary Notice

We are a subcontractor with a contract with a General Contractor. The Owner has a separate name from the General Contractor but they share the same address. Do we need to file an NTO?

It is the law of Florida that if the owner and contractor have a "common identity" a notice to owner is not required. The fact that they both have the same address is strong evidence that they are the same, but not conclusive. If they are both corporations then common officers and directors will prove that they are the same.
