I have a contractor remodeling my home, we paid him 90% the fund and non of the job 100% completed. Now hes avoiding of calls. Initially the work was supposed to be completed in two weeks. Been over two months and still hes telling us today tomorrow and weeks passing an no show.

New Jersey homeowners have a lot of potential leverage against non-responsive contractors because unlawful communications by home improvement contractors amay constitute violations of the Cponsumer Fraud Act, thereby entitling the aggrived consumer to treble damages on any ascertainable losses arising out of that unlawful communication AND attorneys' fees. Signing a contract, accepting payment, and then failing to perform would constituite an unlawful communication. Doing it without a signed contract is DEFINITELY an unlawful communication. If you really paid him that large a deposit and he has not performed at all, then you may be able to press criminal charges for theft of services. I would recommend that you contact a qualified construction attorney to help you sort out your options and get the project back on track.

If the contractor has requested and received payment for work that was never performed, and is now refusing to complete the work, you may have a viable claim for breach of contract and for violations of the New Jersey Consumer Fraud Act. More information would be needed to make a full determination, and I would be happy to discuss by phone whether you should retain counsel and whether you have a claim warranting a lawsuit.
