Do I File as residential or Commercial for a Mechanics lien on 3 family building?

What is a three family residential building considered in New Jersey? Commercial or Residential? If we file a lien, it would be for non payment up to the finish (which still needs to be done since January of this year and scaffolding is still in place). The amount owed includes wall preparation and scratch coat, and lintel repair work per the contract and signed change order under the payment terms.

Even if it's multi-unit, you need to file a residential lien starting with the Notice of Unpaid Balance and seek the confirmation from the American Arbitration Association. That's required per the statute.
