Did the builder miss use the builder trust if he paid all his trades and suppliers and there are no liens on new home

If the builder paid all his trades on a new build and no liens have been applied after 90 days of the occupancy permit has been issued did the builder miss use the builders trust . The owner still owes 200,000.00 of extras and unforeseen costs and decided not to pay after he moved in and said I miss used the funds and he is not paying me . Hired a lawyer and put a CPL against the builders property and told him he will remove it only if the builder removes his CPL against his house . The owner claims he gave the money to the builder and the builder miss used the funds but this a 7000 sqft plus house custom built and total builder costs was 894000.00 and the owner inlay gave him 610000.00 . When the builder put the CPL he though t is was funny and put a cpl in the builders personal property which now a potential buyer walked away from purchasing the builders personal property. As well due to the builders funds now being held or not payed by the owner of the new build he might ha e to file for bank rupcey due to the malicious act the owner of the new house has done and told people how he screwed the builder over .
