Construction Lien

Florida

My contract was terminated by the GC due to non performance of a sub contractor I hired to complete some work on the site. Up to this point, I had not violated the terms of the sub contract agreement. They issued a termination letter and now they want me to sign a full release although I am still owed money for the work that has been completed up until the termination. The remaining balance that was left on the contract was approximately 65K and prior to being terminated, I had invoiced for 11k dollar which was left unpaid. I would like to paid for the outstanding invoice that was submitted prior to termination. Am I in a position to file a lien?

You have the right to file a lien for unpaid labor, services and materials in place. If the termination is improper you would be entitled to lost profit on the remaining work to be done, but you cannot lien for that. If you sign a full release you will give up all rights to being paid any money.

The only way to answer your question with any degree of reliability is
to perform a comprehensive review of the entire situation, including
signed documents (contracts, etc.), along with written communication and
other facts.

I am willing to review the documents and further discuss this with you
and then give you my thoughts on how to proceed.

Please respond by email with the documents and further explanation of
the situation.
