Who needs to apply for the certificate of occupancy , the contractor or the person that hired the contractor to do the job?

It can be performed by either party, but typically the general contractor handles the application which is also typically a term of his contract. The "completion" of construction under many contracts actually requires the certificate of occupancy to be granted, but that is not always the case.
