Can We Still File a Lien?

I'm a subcontractor working on a large commercial project. We delivered materials to our customer on or around 9/20/20. Our customer was kicked off the job by their customer and has refused to pay us until they resolve their lawsuit they are involved with their customer. We did not become aware of this until late November. We sent them a notice of intent to lien that was delivered on 12/21/20. Are we still able to file a lien?

No, all liens for subs must be filed within 120 days of date last supplied labor/service. It appears that time has run. However, you can still pursue the contractor who hired you by filing a suit directly against it. Glad to discuss if you want to reply to this email and provide me your contact info. Jim
