Can they file a lien for the total amount or only for the amount of work completed?

I had a quote for $7000.00 and paid $4800.00. A month after the remodeler was suppose to be done they only had 10% of the work done. I filed a credit card dispute an we are awaiting their determination. The remodeler has threatened to file a lien. Can they file a lien for the total amount or only for the amount of work completed?

Mechanics lien rights are available for those who perform work but go unpaid for that work. And, lien rights will still be on the table even when there's a dispute over what's owed. However, mechanics lien rights will only be available for amounts that are already owed for work performed. And, if there's some work that the claimant has yet to perform, then that work - and the amounts owed for it - wouldn't yet be lienable. But again - if there's a dispute over what should be paid for the work currently done, then that'd have to be sorted out through the dispute.
