Can my mechanics lien be amended in the state of Washington?

We recently filed a lien in the state of Washington, as we were owed $26, 843.90. We were unable to get in touch with the customer, but have since. A credit was given for some of the work and now they owe $19, 104.90. Is there a way to amend the total for the lien to a lesser amount OR release that portion?

Yes, this has been long established by the Washington Supreme Court. A claimant can file a new or amended lien claim within the 90-day period following the completion of the work. Additionally, the 8-month foreclosure deadline will run from when the new or amended lien was filed. Practically speaking, although I am not too familiar with the WA recorders' offices, I do know the challenges in dealing with them as a whole; and county recorder offices can be fickle creatures. Many are unfamiliar with the lien amendment process. The simplest route may be to just release the filed claim and file a new one. That is, of course, if you are still within the deadline to do so.

Is it required that we adjust if a credit has been given after the fact? I am trying to see if it is something necessary, as the customer is the one requesting it.

Yes, you may amend the lien by simply preparing and providing an Amended Lien.  However, you don't get any revised time periods. The time deadlines from the original lien still stand.

Yes, you can file a partial release of lien or if you are within your 90 days you can amend the lien or if it goes all the way to foreclosure, your complaint can ask for the accurate amount owing at the time.
