Can mechanic lien be file in this situation

I have a contract with this guy to do my kitchen and bathroom. He got 3/4 of the money. He offered to do my upstairs floor in exchange for a car my husband is selling. Well the material he wants to used my husband refused. At first he decided to change to a better material, now he change his mind and want us to pay him ex amount, we off a reasonable amount and he refused. Still he has not finish the job we had a contract on. He’s filing a mechanic lien on our property.

Because this is a residential property, the contractor will need both your and your husband's signatures on a written contract in order to hold a valid lien on the work he seeks recovery on. Now, that does not stop him from filing a lien, and does not prevent him from filing suit even if he does not have a valid lien. In order to remove an improper lien (if you have the proper grounds) you must file suit. So it is best to negotiate a resolution to these situations if possible. Otherwise, the necessary court intervention to resolve the dispute can get expensive quickly. Hello, Once you file a valid lien you can file a lawsuit at any time to enforce it. If you filed your own lien, you may want to have an attorney review it to make sure it is valid before you file a lawsuit.
