Can I still file a mechanics lien if I missed including the bond agencies on the job?

Our rep included the public property owner and the GC on the prelim notices but missed including the three bond agencies on the job. Client has not paid and we were gong to file a mechanics lien until we had noticed this. Full project has not yet finished. Estimated to finish 6/30/2022.

Failing to include a bond company should not impact your lien rights, but it sounds like this is a public project which means you do not have mechanics lien rights. Other options exist for securing bond rights in the event you did mess up the preliminary notice; those require a notice after completion and the timing for that is short. Given the potential issues you should have your attorney review your paperwork, prelim etc. to confirm whether your preliminary notice is enforceable or if you need to avail yourelf to the secondary notice to try and revive your bond rights.
