Can I still file a mechanic's lien?

TexasRetainage

Hello, I sent a mechanic lien notice to a customer who won't pay for a finished project. He in turn has hired an attorney and we have received a notice of claim with a lot of false accusations.

Hello,

Of course you can file your mechanic's lien. Just be aware that for them to remove the mechanic's lien, they will have to sue you. If you believe that your claims have merit, you should file it. If you have already been paid for the work that you did, filing a lien is likely to be a costly mistake.

You should be aware that the attorney will be seeking to prove up the claims made in the demand letter and likely already has some indication of their truthfulness. You may want to consider contacting your own counsel to evaluate the merits of their claims with your evidence.
