Can i still file a Lien on a commercial project that the retain is past due since 12/23/2019?

I'm a subcontractor that performed framing on a commercial project in Texas, everything was paid except the 10% retain for issues between the owner and the general contractor. Our trade was completed and the only reason i haven't been paid is because of a disagreement between the owner and GC unrelated to my work. The retain invoice was due 12/23/2019 and i still haven't been paid. can i still file a lien on the property? owner and GC says that as soon as they come to an agreement i will get paid but it has been 5 months already and they cant seem to reach an agreement. My contract says that i am entitled to legal fees compensation if i win the case. Thanks.

Hello, You are, unfortunately, outside of your window to file a lien on the retainage. You do, however, have a fairly clear breach of contract claim based on what you've stated here. You may file suit to recover that final 10%. E. Aaron Cartwright III 214-789-1354 Aaron@EACLawyer.com
