Can I still file a lien if I didn’t send a prelim after 6 months?

I live in California and I am a material supplier. I have a customer that never was a problem, but now he is. He has owed me around $1000 for the last 6 months and claims he doesn’t have the money to pay me. I didn’t prelim him because of the low amount and previous payment history. Can I still file a mechanics lien, or what are my options? Mike

Is your customer the property owner?  If so, you might be excused from the preliminary notice requirement.  If not, and your customer was a subcontractor or direct contractor on the job, you may only have a direct right of action for breach of contract against your customer. ----CN
