Can I renew a mechanics lien in Arizona before the 6 month deadline?

Arizona

I have filed a 20 day preliminary notice when we delivered materials. We have not gotten paid on the job. We filed a lien within the 120 days and with Arizona laws, the lien is set to expire in a couple weeks. What can I do to extend the lien while I wait for our attorneys to work on the court filings?

Unfortunately, you can't extend the deadline to foreclose on a lien in Arizona. You will need to file the lawsuit before the expiration of the statutory deadline. Generally, lien foreclosure lawsuits are not too complex and can be drafted and filed in short order. If there are deficiencies in the original filing, the complaint may be amended to remedy the deficiency if done so before an answer is filed. It may be that your current attorney is simply too busy and you may want to consult with a different attorney.
