Yes you can. But that contractor would not be able to sue you here in Arizona unless they are licensed here, and he will be breaking Arizona law. Arguably those are not your problems. The drawback for you is that he will not have a license bond here in Arizona that is a potential source of recovery for you if things go south, and if the project is residential, you will not have access to the registrar of contractors' recovery fund.
