CaliforniaLien Foreclosure

Thru LEVELSET I recorded mechanics liens on 2/7/20 on a residential job completed on 9/5/19 The 90 days to file for foreclosure will be this coming week. Can I file for foreclosure myself or need to hire an attorney? or you guys can help? I have been in touch with customer which have been saying he will pay but, i am running out of time. Please help.

If you recorded your mechanic's lien on February 7, 2020, the 90-day deadline to file a foreclosure action would be May 7. Note that if the job was complete on September 5, 2019, your lien may have been untimely. If you believe the foreclosure deadline is going to run soon, and your customer is willing to pay but just needs more time, your customer can agree to extend the deadline. A foreclosure action is not simple, and mistakes can jeopardize your claim. Unless you have significant experience representing yourself in court, I wouldn't recommend that you do so on a lien foreclosure action.

Is there a legal form or can I put a letter where we can ask him to fill/sign his promise to pay as soon as he sales? Please reply. ✌ Thanks.

Also, can you please add yourself as my representative so, if needed you can represent me. Actually, you can e-mail him requesting signature/promise so, we don't file for foreclosure this week.✌
