If we rented/delivered equipment to a job site for a sub in Colorado in April of 2020 and they are currently renting this equipment, but are past due, can I file a mechanics lien on the job site? I know the deadline in Colorado is "4 months after last providing services or materials". Does that deadline start from the day we deliver the equipment or from the last time the customer uses it, which in this case would be 5/3/21?
You can lien for most rental equipment used on a project. 4 months typically is last date of work since it is sent. The real question becomes whether the amount owed is worth pursuing a lien claim. Best of luck.
