Can I file a mechanics lien?

Our customer breached terms of payment on a project. The customer has given us false information as to when payment will be made. Customer stated ' check is in the mail on one occasion and sent us to an office to pickup the check only to be told nobody is in the handle the situation.

If you performed work on a project in Ohio and you have not been paid for that work, then you have a right to file a mechanic's lien. 

That being said, the owner of the project may have a defense to the lien if it filed a notice of commencement and you did not serve a notice of furnishing. 

Your clock to file a lien begins to run after your last day of work on the project. A lien on a residential project must be filed within 60 days of the last date of work. A lien on a commercial project must be filed within 75 days of the last date of work.
