Can I file a mechanics lien?

Our company is a labor only company. We started a job that required a 3 draw payment. While doing work at the home the clients request for additional work to be completed which turned our now 3 draws to 4 draws. The client has paid 2 of the 4 draws, we have requested for the 3rd draw to get us through the remainder of the job until completion where the 4th & final draw will be processed. Clients are refusing to pay that 3rd draw which forced us to stop working. Are we able to file a mechanics lien on the clients property?

I would have a few questions regarding the structure of your contract and whether the additional work was subject to a change order. My concern would be that the final draw (originally 3) was to be paid upon completion. Without proper documentation, they could have an argument that it wasn't due yet. Ultimately, I would recommend sending a letter trying to get the job back on track. If the homeowner refuses to cooperate, I would recommend moving towards termination of the job and filing a lien.
