Can I file a mechanics lien?

Arkansas

We worked on some oil wells for a company back in July in Arkansas and haven’t been paid. Wondering what type of lien form to use.

Arkansas law provides for a specific and distinct lien for parties who perform labor or supply materials for "digging, drilling, torpedoing, operating, completing, equipping, maintaining, or repairing of any oil or gas well, water well, mine or quarry, or oil or gas pipeline." These liens are set forth by Mechanics' and Materialmen's Liens Subchapter 2 - Wells, Mines, and Quarries Generally, § 18-44-202 et seq.

To the extent that the work would also qualify for a regular mechanics lien, that protection is also provided and the remedies are to be cumulative.

For a regular mechanics lien, the infomration that must be provided on the lien document is set forth by § 18-44-117. Or, you can take care of it quickly and easily electronically here.

And luckily enough, with respect to a "well, mine, or quarry" lien as discussed above, the lien "shall be construed, established, preserved, and enforced in like manner and in the same time as liens of mechanics." It would likely be a good idea, however, to cite the specific "Subchapter 2" on the lien claim document to ensure the proptection of both particular sections.
