Can I file a mechanics lien?

I'm a sub on a construction project performing final cleaning. The project owner asked me if would enter into a contract with for housekeeping services upon grand opening as he was not abel to hire enough staff before opening. Serveral of my employees have been working as contracted housekeepers since 12/18/21. On this coming Monday, 1/17/22, I will be due $11,370. To make matters worse, my employee told me the owner gave her a new hire packet but he hasn't mention anything to me about hiring them to me .

It is a condition precedent to a valid lien that the lien claimant must complete and serve a preliminary written notice of lien rights on all required parties, including the owner or reputed owner not later than 20 days after the claimant’s first contribution of labor, services, tools, materials, fixtures, or machinery to the job site. If this was not done, you may not file a lien. 

If they do not pay, contact a construction attorney as you still have rights to sue for the amount due and other possible claims depending on the facts.

If the current employees started working on Dec. 27th would I still be within the 20 day period if I filed today?

If you serve a preliminary notice today, this will only secure rights for the amount of the labor or materials provided in the 20 days before the service of the preliminary notice and any time thereafter ARS 33-992.01(E).
