Can I file a Mechanics Lien?

Our engineering department is preparing plans and designs for a land developer and at this point he is not paying our January 2021 to present AIA applications. We have a contract with the developer for our services on the project. Are we able to file a Mechanics Lien on the project?

Engineers who have direct contracts with the property owner are eligible to lien the property, but only if their scope of work included (or anticipated) the supervision of construction activities on the subject property, provided that the lien claim is filed within 6 months of the last day that work was provided per the contract. My general advice to cients and potential clients is that filing a lien represents the most efficient route to recover what is owed. If your company qualifies, you should probably file the mechanics lien claim ASAP.

Yes, as an architect, you can file a lien.

The deadline is 6 months after last date of work.
