Can I file a mechanics lean?

I am an owner designee on a residential project that is vacant and approximately 60% finished. Was on the job 8 weeks and departed due to non-payment.

If you have a contract with the owner and provided services for which you have not been paid, you can file a lien if you are within the statutory 90 day period from your last date of work on the project.

We had already agreed to my fee when he hired me. I didn't seek this position. He sought me out and actually harrassed me until I agreed to take it. I really wasn't in a position to take it because of commute to the site. He kept saying he didn't get the contract, then he said he was going to have his attorney look at it, but my money is good- it was just a formality. He also expanded the scope of my work to included interior design on the project and that cause the expenses to increase exponentially, so I felt I had to step away because he kept changing his mind on every decision on the project.
