Can I file a mechanic’s lien on two properties if homeowner lives in one but is building another one that I did work on?

A home owner divided his property, now each one has its own address. I did work on the new home being built. Can I place a lien on both properties?

You can only file a lien on the property where you performed your work. If you end up having to file suit, you can include both amounts in any lawsuit.

Yes, if you performed construction work or supplied materials towards the construction or repair, you have the right to file a lien (assuming you are with the 90-day limit and your work was within the scope of your contract). It does not matter whether the owner resides or occupies the property.

I want to be clear. If the lots were divided before you began any work, you cannot lien the lot where you performed no work. However, if you performed work on both lots per request, you may lien both (assuming you are within 90 days and the work you performed was within the scope of your contract).
