Can I file a mechanic lien due to customer refusal to co-sign 2 party check?

I have a situation with a customer who refuses to sign/endorse the check payment I received from the insurance company for a water damage mitigation job we have completed a month ago. The insurance company sent me a check which made 2 party out to my company and additionally the insured (customer) name. So until the customer sign as well, I'm not able to deposit this check.

If you have an agreement with the owner of the property, you have performed the work, and the owner breaches the agreement by not paying, you can lien the property. If your business installs improvements or repairs that are paid by insurance claims, you should amend your contract to state as much and eliminate any ambiguity.

Yes … if the customer refuses to sign and you cannot cash the check, you have not been paid and can file a lien.
