Can I file a MA lien

Massachusetts

I am a contractor who ordered materials for a commercial location on the tenants behalf. The job was approved but after the materials were ordered and shipped to us (customer materials that we can't return or restock) the client then cancelled the job and is now refusing to pay for the material costs. Since we never actually performed any work at the location I am wondering if we can still place a lien.

If they were only shipped to your facility and never delivered to the job site or incorporated into the building there, you are not entitled to a lien. If the tenant has other assets that you know of you might try filing suit and attempting to obtain prejudgment security on those assets.
