Can I file a lien in Pennsylvania for rental equipment unpaid?

I am a material supplier and have not been paid for rental equipment provided on a construction project in Pennsylvania.

Yes, equipment lessors are protected under PA lien laws, and are specifically included under the definition of "subcontractor," "anyone who... suppliers or hauls materials, fixtures, machinery or equipment reasonably necessary for and actually used therein."

Two things to note regarding Pennsylvania mechanics liens.

  1. Depending on the project, a Notice of Furnishing may have been required to secure your right to lien; i.e projects worth over $1.5M and the owner filed a Notice of Commencement. 
  2. The deadline to file a lien in PA is 6 months from the last date of furnsihing labor/materials to the project. However, before filing, a Notice of Intent to Lien must be served on the property owner at least 30 days prior.
