Can I file a lien if the property owner files against my bond?

The property owner hasn't given the final payment. I've given notice of intent to move forward with collection options. I intended to file the lien on Tuesday but received notice of the property owner making a claim against my bond. Do I need to wait to file the bond?

If your denying that you breached the contract and/or caused any defects, then the surety bond claim will probably be denied. Assuming you performed the contract in accordance with the Contractor's State Licensing Laws and Local Building Codes and regulations, you do not have to wait for the bond claim resolution to file the lien.

Your lien rights are separate from the bond claim and will expire if you don't exercise them.
