Can I file a lien against the homeowner?

I finished a project for water mitigation services, the insurance only paid a small portion of the job unfairly and are refusing to pay anymore. The homeowner is not helping with the claim. Are we able to file a lien?

Yes. But there are very specific rules that one must follow to file a Construction Lien Claim in NJ when it's a private residence. It's a little bit of a unique process to NJ that is too involved to post on at length here. Feel free to call or email me if you would like to discuss it further.

NJ requires a written contract between the parties to file a mechanic's lien. If you have a contract with the homeowner, you should be able to lien the home independent of what their insurance carrier says if your lien claim is filed in a timely manner. 

Since this is a NJ residential property, you will first have to file the Notice of Unpaid Balance (the "NUB") and seek the arbitration award prior to filing the lien.
