Can I file a construction Lien if the Permit has not been closed.

Florida

I am a General Contractor and the Job has been stopped due to non payment. I have an open permit and have been waiting on another contractor on a separate project in order to finish and close the permit. I am owed a progress payment for services rendered to date.

The fact that the permit is open does not prevent you from filing a construction lien, provided that the payment is due and it is within 90 days of the last date on which you performed substantive (i.e. not just punch-list) work on the project.
