Can i do this, and this way?

Kentucky

I have a shop building I leased to a company. They paid me for three years or so, The original company with the lease sold out to another company a 6 months or so after they filed bank bankruptcy. The new company that owns the equiptment has not paid lease payments for about a year now. They still have a high value of equipment still on and inside my property. The original lease had a clause that either party could canceal the lease with a three month notice. The new company that own the equipment here now, have never signed anything with me. I would like to file a mechanic lein on the equipment still stored here. I would like to send them a invoice for the frist three months that they never paid the lease payment considering this frist three months a cancealation of the lease and then invoice them a storage fee for $350.00 per day for the other 9 months.

A construction mechanics lien in Kentucky is only available to parties who have provided labor or material to a construction project. There are other types of liens, but most liens on equipment arise only by the voluntary act of the owner. There are specific liens for storage with respect to some property (automobiles, aircraft, household goods, etc.), but these likely don't apply to equipment, especially if there is no agreement to store the equipment for some fee.
