Can I both send a stop notice and file a lien in AZ?

Hi, I'm a subcontractor, and I sent a stop notice for a commercial job that I've been on. However, I haven't been paid still, it's been a few months, and I'm not sure what to do. Can I also file a lien if my deadline hasn't passed yet? Or am I out of luck with the lien since I already sent a stop notice?

A stop notice is a demand upon an owner or construction lender by a material supplier or subcontractor to 'stop paying' a contractor who has failed to pay the material supplier or subcontractor. The stop notice gives a claimant a chance to seek money, rather than a lien against the equity (if any) in the project. Claimants may pursue both the stop notices and the liens, simultaneously if they wish. So if there is no money currently due, then your stop notice may not have caused a problem yet. Hard to say why you haven't heard anything. There is absolutely no harm in recording your mechanic's lien early. However, if you still have work to be done on the project, you may want to consider that it will be a hassle to keep releasing and rerecording the lien as the amount due goes up.
