Georgia laborers are entitled to file a mechanics lien if they've performed work but gone unpaid. Recall, though, that a mechanics lien will not attach directly to an employer. Rather, mechanics liens attach to the underlying project property. And, of course, mechanics lien rights will only arise when work has been performed but gone unpaid when that work has permanently improved project property. Keep in mind, though, that merely threatening to file a mechanics lien can help recover payment without the actual need for a mechanics lien filing. When a document like a Notice of Intent to Lien is sent both to the party who's failed to make payment and to the owner of the project property, there may be more pressure on an employer to ensure that payment is made and a lien claim is avoided.
