Can contractor with no preliminary notice who hasn't done work fof 130+ days file a lien on my house?

Hi Im a homeowner with a home remodel. Licensed contractor was doing work. No contract just list of stuff to do. Some with prices. Some TBD. Last time he did work was Jan 14. And no communication from him until yesterday May 2. No preliminary lien notice was provided. Its now 130+ days and no work or communication has happened. Hes threatened a lien if i dont pay him (more). I have made "progress payments" and also provided all materials. I am trying to determine if he can even file a lien since there was no prelim notice and we're past 120 days. Thanks for any help.

A contractor has 120 days from the last date of work to serve you notice of their lien and record the same with the County Recorder/Registrar. If they fail to follow the statute, their lien claim would fail. They do, however, maintain a contract claim against you personally for payment. If you have additional questions, feel free to call.
