Can a subcontractor refuse to submit a conditional final waiver, unless previous payments are made?

I have 2 progress invoices and 1 final invoice from a sub for a project. They sent me 3 conditional progress releases and refuse to send a conditional final until they are paid for the previous progress invoices. How can I explain to them that I need a conditional final to go with the conditional invoice?

The Conditional Final Waiver form has a line right on there for your sub to put down the amount of any unpaid progress payments so he doesn't lost his rights for those. He should sign the Conditional Final form with that insertion so you can process his payment.
