Yes … Under Pennsylvania law, a contractor’s claim does not become a lien against the property until a judgment is entered. A mechanic’s lien is an exception to this principle. A mechanic’s lien serves a lien against the property immediately. We therefore recommend that our client’s file mechanic’s lien claims in most instances when they have the right to file a lien. Determining projects on which a lien can be filed and perfecting a lien (which is necessary for it to remain valid) can be tricky, due to the complexity of Pennsylvania’s mechanic’s lien law. We therefore recommend that contractors retain an attorney to file their mechanic’s lien claims.
