Can a lien be filed without a contract

KansasMechanics Lien

I have a question with regard to somebody threatening me to put a contractors lien on my house. In February of this year, my now ex-boy friend moved into my house with me, and during his stay there for the past 5-6 months he volunteered to do some work on the house. I didn't have the money to do the things he was offering to do, such as a remodel on the bathroom, deck work, windows, and some door installations. I explained to him that I could not afford to pay for all these materials, but he told me not to worry about it, and that he had it covered. He ended up paying for most of the materials and started the work against my will, even when I reminded him I could not afford the materials he continued to make purchases and continue the work. There was never an agreement, written or verbal, in place to authorize all these materials and labor. We since have broke up and he moved out of the house. He is a general contractor and he is now threatening me to put a lien on my house. Can he rightfully and legally file for a contractor lien on my house?

Kansas statute sets out what a contractor has to do to file a lien. Whether the lien is enforceable is the important question. The enforceability of a lien requires specific adherence to the statute and it is wise to seek legal advice.
